Proposed Amendment to Prior Development Approval (DA5367) to remove condition requiring the imposition of an easement at 4 Bergen Way (DA2024/556)

The abovementioned development application is currently being advertised for public comment until 1 July 2024.

Details of the application are as follows: 

• The application proposes to amend a previous planning approval on the subject site (DA5367) to remove a condition which required the imposition of an easement to allow public access to the vehicular accessway and car parking areas on the property at 4 Bergen Way, Mindarie;
• Despite the imposition of the condition, the development was constructed and occupancy granted, without an easement being registered; and
• The application also proposes to install bollards at the points where the property lines intersect.
